These terms govern your access to and use of the Estra Marketing AI website. Paid services are supplied under a separate written proposal, scope or service agreement.
General information about Estra, our marketing systems, services, industries and pricing.
A project begins only after the applicable written scope and commercial terms are accepted.
Our systems support marketing activity, but specific leads, revenue or commercial results are not guaranteed.
Website terms and client agreements are different
This website explains Estra’s general business model and current public offering. It does not create a client engagement by itself. No paid build begins until the relevant written scope and commercial terms have been approved.
1. Agreement to these terms
By accessing or using this website, you agree to these Terms of Use and our Privacy Policy. If you do not agree, you should not use the website.
“Estra”, “we”, “us” and “our” refer to Estra Marketing AI, ABN 32 851 966 166. “You” means the person accessing the website and, where applicable, the business or organisation they represent.
You confirm that you are legally capable of agreeing to these terms and that information you submit through the website is accurate to the best of your knowledge.
2. About Estra Marketing AI
Estra designs and builds practical marketing systems for Australian businesses using supported platforms such as Claude and ChatGPT.
Depending on the agreed scope, services may include discovery, system design, configuration, testing, training, handover, launch support and optional maintenance.
Unless a written agreement expressly states otherwise, Estra does not operate as an unlimited outsourced marketing department. The client remains responsible for operating the delivered system, reviewing outputs, approving and publishing marketing, managing advertising accounts and budgets, and responding to leads and customers.
3. Website information
This website provides general information about Estra, our process, services, systems, target industries and indicative public pricing. Website content may not cover every requirement, limitation, exception or project-specific cost.
Website content is not legal, accounting, tax, financial, credit, employment, marketing-compliance or other regulated professional advice. You should obtain professional advice appropriate to your circumstances and industry.
We aim to keep the website useful and current but do not guarantee that every page will always be complete, accurate, current or continuously available. Material information should be confirmed in a written proposal or agreement before you rely on it.
4. Enquiries and engaging Estra
Submitting a Contact or Systems Review form, subscribing to our newsletter or communicating with Estra:
- does not guarantee a meeting, recommendation or acceptance as a client;
- does not create a service agreement, partnership, agency, fiduciary duty or employment relationship;
- does not authorise Estra to access accounts, publish marketing or act on behalf of your business; and
- does not require either party to proceed with a paid engagement.
A paid engagement begins only when the required parties accept a written proposal, statement of work, service agreement or other contract and any applicable payment conditions are satisfied.
If an accepted service agreement conflicts with these website terms, the service agreement will govern the paid engagement to the extent of that conflict.
5. Pricing, GST and third-party costs
Unless expressly stated otherwise, prices displayed on the website are in Australian dollars and exclude GST.
Public pricing describes Estra’s standard scope at the time it is published. A final quote may differ when a project requires additional agents, unusual data preparation, custom development, unsupported integrations, migrations, complex approval processes, multiple brands or platforms, or other non-standard work.
Subscription charges, usage costs and fees for Claude, ChatGPT, advertising platforms, CRM software, email services, SMS services, website hosting, automation platforms and other third-party tools are not included unless the written proposal expressly states otherwise.
Estra does not currently accept payments through this website. Payment terms for paid services will be included in the applicable proposal, invoice or service agreement.
We may change website pricing prospectively. A website price change will not alter an already accepted written agreement unless that agreement allows the change.
6. Marketing outcomes and no guaranteed results
Estra designs systems intended to improve marketing capability, consistency, organisation and workflow. We do not guarantee a specific number of leads, enquiries, sales, customers, bookings, rankings, conversions, revenue, profit, time savings or other commercial result.
Results depend on factors outside Estra’s control, including your offer, pricing, market, reputation, location, competition, data quality, advertising budget, staff adoption, approval speed, implementation, platform changes, lead handling and customer decisions.
Examples, calculations, illustrations, testimonials and descriptions of possible outcomes are provided for general context. They are not promises, forecasts or guarantees about the performance of your business.
7. AI systems and human review
Outputs produced through Claude, ChatGPT and similar technologies may be incomplete, inaccurate, outdated, inconsistent, generic or unsuitable for a particular purpose. Outputs can also reflect limitations in the source information and instructions supplied.
Estra may test workflows during an agreed build, but no AI-assisted system can eliminate every error or replace professional judgement.
An authorised person must review and approve outputs before they are published, included in advertising, sent to a customer or relied on for a business decision.
Estra’s marketing systems do not provide legal, tax, accounting, financial, credit, medical or other regulated professional advice. Qualified or authorised professionals remain responsible for reviewing technical, regulated and industry-specific claims.
8. Client responsibilities
Detailed client responsibilities will be included in the applicable written agreement. They will generally include:
- Providing accurate, authorised and current business information.
- Ensuring you have the right to provide all source material, documents, brand assets and data.
- Nominating appropriate users and approval owners.
- Keeping changing information such as prices, offers, stock, rates, availability and business claims current.
- Reviewing and approving every output before use.
- Complying with advertising, privacy, consumer, intellectual-property, professional and industry obligations.
- Protecting account credentials and controlling access to connected platforms.
- Deciding what information authorised users enter into Claude, ChatGPT and other platforms.
- Managing publication, campaigns, enquiries, leads, customers and commercial decisions.
You must not provide passwords, payment-card information, sensitive records or confidential third-party information through a general website form.
9. Third-party platforms and services
Estra’s website and marketing systems may rely on third-party services such as Hostinger, WordPress, Brevo, Google, Meta, Claude, ChatGPT and other hosting, CRM, email, analytics, advertising or automation tools.
Third-party services operate under their own terms, privacy policies, subscription arrangements, availability and technical limitations. Estra does not control a third party’s service outage, policy change, feature removal, price increase, security incident, data-processing practice or decision to restrict an account.
We may recommend or configure a third-party platform, but the client remains responsible for reviewing its terms, maintaining required subscriptions and using it lawfully unless a written agreement expressly states otherwise.
10. Intellectual property
Website content
Unless otherwise stated, Estra or its licensors own the website design, written content, graphics, logo, brand elements, templates and other website material.
You may view and print reasonable extracts for internal evaluation. You must not reproduce, modify, sell, republish, scrape, distribute or commercially exploit website content without written permission.
Client deliverables
Ownership and licence rights relating to client systems, agents, prompts, documents, templates, background tools, third-party material and client-supplied content are governed by the applicable written service agreement. Nothing on this website transfers those rights by itself.
Feedback
If you voluntarily provide general suggestions about our website or services, Estra may use those suggestions without payment or obligation, provided we do not identify you or disclose confidential information without permission.
11. Acceptable website use
You must not:
- use the website unlawfully, fraudulently or in a way that harms another person;
- attempt to gain unauthorised access to the website, forms, systems, accounts or data;
- introduce malware, interfere with security or disrupt website availability;
- scrape, crawl or systematically extract website content without written permission, except for ordinary search-engine indexing;
- impersonate another person or submit false, misleading or malicious information;
- upload confidential or personal information belonging to another person without authority;
- infringe intellectual-property, privacy or other legal rights; or
- use Estra’s name, logo or content in a way that falsely suggests endorsement or affiliation.
We may restrict access, block submissions or take other reasonable action if we believe the website is being misused.
12. Privacy and communications
Our Privacy Policy explains how we collect, use, store and disclose personal information.
Submitting an enquiry does not automatically subscribe you to ongoing newsletter marketing. If you separately subscribe, you may unsubscribe using the link provided in the email.
Necessary communications about an enquiry, proposal, active project or support request may still be sent where required to manage that interaction.
13. Australian Consumer Law and liability
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
Businesses may qualify as consumers under the Australian Consumer Law in some circumstances. Where applicable, services may carry guarantees that they will be provided with due care and skill, be fit for an agreed purpose and be supplied within a reasonable time when no timeframe has been agreed.
Subject to non-excludable legal rights and to the maximum extent permitted by law:
- the website is provided on an “as available” basis;
- Estra is not liable for decisions made solely in reliance on general website information;
- Estra is not responsible for third-party websites, platforms, outages, changes or content it does not control;
- Estra is not responsible for information or material submitted without authority; and
- Estra is not liable for indirect or consequential loss arising solely from website use where that liability can lawfully be excluded.
Liability, warranties, remedies and risk allocation relating to a paid service will be governed by the applicable written agreement and any mandatory legal rights.
14. External links
The website may contain links to third-party websites, resources or platforms for convenience. A link does not mean Estra endorses, controls or accepts responsibility for that third party.
You access external websites and services at your own discretion and should review their terms, privacy practices and security arrangements.
15. Website availability and changes
We may update, suspend, withdraw or change the website, its content or these terms at any time. The current Terms of Use will be published on this page with their latest effective date.
We do not guarantee uninterrupted access to the website. Maintenance, security events, provider outages, technical problems and circumstances beyond our reasonable control may affect availability.
16. Governing law and contact
These Terms of Use are governed by the laws of Tasmania, Australia and applicable Commonwealth laws. Subject to any non-excludable rights, the parties submit to the courts with jurisdiction in Tasmania.
If any part of these terms is invalid or unenforceable, it is to be read down to the extent necessary where possible. The remaining terms will continue to apply.
A delay in enforcing a right under these terms does not automatically waive that right.
